1. Provider

These Terms of Service govern your use of the Lunio app. The app is provided by Elevatrade UG (haftungsbeschränkt). For full company details, see our Legal Notice (Impressum).

2. Acceptance of Terms

By creating an account or using Lunio, you agree to these Terms of Service and our Privacy Policy.

If you do not agree to these terms, please do not use the app.

You must be at least 16 years old to use this app. If you are under 16, you may only use the app with parental consent.

3. Service Description

Lunio is a personal daily signal app designed to give you and your loved ones peace of mind. The app:

Reminds you to send your signal at your scheduled time
Notifies your designated contacts if you miss your signal
Helps your loved ones know you're okay

Please be aware that Lunio is:

A communication tool, not an emergency service
Not a medical device or health monitoring system
Not a substitute for calling emergency services
Not a guarantee of contact availability or response

4. User Responsibilities

You are responsible for:

Providing accurate account and contact information
Obtaining consent from your contacts before adding them
Sending your signal at your scheduled time or adjusting your schedule
Maintaining the security of your account credentials
Ensuring your device has internet connectivity for notifications
Informing your contacts about the nature and purpose of the notifications they may receive

5. Contact Consent

Before adding someone as an contact:

You must inform them about Lunio and its purpose
They will receive an invitation and must confirm their participation
Contacts can unsubscribe at any time using the link in any notification
You must not add contacts who have asked not to be contacted

Misuse of the contact feature (e.g., harassment, spam) may result in account termination.

6. Subscriptions and Payments

Lunio offers free and paid (PRO) subscription plans:

FREE Plan:

Email notifications to contacts
Up to 3 email contacts

PRO Plan:

Email and SMS notifications
Up to 10 email contacts
Up to 3 SMS contacts

Subscriptions are billed through the Apple App Store or Google Play Store. Prices are displayed in the app and may vary by region.

You can cancel your subscription at any time through your device's subscription settings. Cancellation takes effect at the end of the current billing period.

7. Limitation of Liability

To the maximum extent permitted by law:

Lunio is provided "as is" without warranties of any kind, express or implied.

We do not guarantee:

Continuous, uninterrupted, or error-free service
Delivery of all notifications (email, SMS, or push)
That the app will meet your specific requirements
That the app will prevent any harm or emergency situation
Any particular response from your contacts

We shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, or goodwill
Personal injury or property damage
Any damages exceeding the amount you paid us in the past 12 months

This limitation applies regardless of the legal basis of the claim (contract, tort, or otherwise).

8. Your Responsibility

You are responsible for your use of the app and for any consequences of misuse. If your actions cause claims or costs to us or third parties — for example through violation of these terms or misuse of the contact feature — you bear responsibility for those consequences.

9. Account Termination

You may delete your account at any time through the Settings screen.

We may suspend or terminate your account if you:

Violate these Terms of Service
Use the app for illegal purposes
Misuse the contact feature
Engage in harassment or abuse

Upon termination, all your data will be deleted in accordance with our Privacy Policy.

10. Modifications

We may modify these terms at any time. We will notify you of significant changes through the app or by email.

Your continued use of the app after changes constitutes acceptance of the new terms.

If you do not agree to the modified terms, you should stop using the app and delete your account.

11. Governing Law and Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany.

Any disputes arising from or relating to these terms or the use of the app shall be subject to the exclusive jurisdiction of the courts of Steinfurt, Germany (Amtsgericht Steinfurt).

If you are a consumer, the mandatory consumer protection laws of your country of residence apply in addition to these terms. EU consumers may also use the Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

12. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Diese Nutzungsbedingungen regeln Ihre Nutzung der Lunio-App, bereitgestellt von der Elevatrade UG (haftungsbeschränkt). Vollständige Unternehmensangaben finden Sie in unserem Impressum.

2. Annahme der Bedingungen

Durch die Erstellung eines Kontos oder die Nutzung von Lunio stimmen Sie diesen Nutzungsbedingungen und unserer Datenschutzerklärung zu.

Wenn Sie diesen Bedingungen nicht zustimmen, nutzen Sie die App bitte nicht.

Sie müssen mindestens 16 Jahre alt sein, um diese App zu nutzen. Wenn Sie unter 16 sind, dürfen Sie die App nur mit Zustimmung der Eltern nutzen.

3. Leistungsbeschreibung

Lunio ist eine persönliche Signal-App, die Ihnen und Ihren Liebsten ein gutes Gefühl geben soll. Die App:

Erinnert Sie daran, Ihr Signal zur geplanten Zeit zu senden
Benachrichtigt Ihre festgelegten Kontakte, wenn Sie ein Signal verpassen
Hilft Ihren Liebsten zu wissen, dass es Ihnen gut geht

Bitte beachten Sie, dass Lunio:

Ein Kommunikationswerkzeug ist, kein Notdienst
Kein Medizinprodukt oder Gesundheitsüberwachungssystem ist
Kein Ersatz für Notfalldienste ist
Keine Garantie für die Verfügbarkeit oder Reaktion von Kontakten bietet

4. Nutzerpflichten

Sie sind verantwortlich für:

Die Angabe korrekter Konto- und Kontaktinformationen
Das Einholen der Zustimmung Ihrer Kontakte vor dem Hinzufügen
Das Senden Ihres Signals zur geplanten Zeit oder das Anpassen Ihres Zeitplans
Die Sicherheit Ihrer Kontodaten
Eine Internetverbindung Ihres Geräts für Benachrichtigungen
Die Information Ihrer Kontakte über Art und Zweck der Benachrichtigungen, die sie erhalten können

5. Einwilligung der Kontakte

Bevor Sie jemanden als Kontakt hinzufügen:

Müssen Sie die Person über Lunio und dessen Zweck informieren
Erhält sie eine Einladung und muss ihre Teilnahme bestätigen
Können Kontakte sich jederzeit über den Link in jeder Benachrichtigung abmelden
Dürfen Sie keine Kontakte hinzufügen, die darum gebeten haben, nicht kontaktiert zu werden

Missbrauch der Kontakt-Funktion (z.B. Belästigung, Spam) kann zur Kontokündigung führen.

6. Abonnements und Zahlungen

Lunio bietet kostenlose und kostenpflichtige (PRO) Abonnements:

Kostenlos:

E-Mail-Benachrichtigungen an Kontakte
Bis zu 3 E-Mail-Kontakte

PRO:

E-Mail- und SMS-Benachrichtigungen
Bis zu 10 E-Mail-Kontakte
Bis zu 3 SMS-Kontakte

Abonnements werden über den Apple App Store oder Google Play Store abgerechnet. Die Preise werden in der App angezeigt und können je nach Region variieren.

Sie können Ihr Abonnement jederzeit über die Abonnement-Einstellungen Ihres Geräts kündigen. Die Kündigung wird zum Ende des aktuellen Abrechnungszeitraums wirksam.

7. Haftungsbeschränkung

Im gesetzlich zulässigen Rahmen:

Lunio wird "wie besehen" ohne ausdrückliche oder stillschweigende Gewährleistungen bereitgestellt.

Wir garantieren nicht:

Einen kontinuierlichen, unterbrechungsfreien oder fehlerfreien Dienst
Die Zustellung aller Benachrichtigungen (E-Mail, SMS oder Push)
Dass die App Ihren spezifischen Anforderungen entspricht
Dass die App Schaden oder Notfälle verhindert
Eine bestimmte Reaktion Ihrer Kontakte

Wir haften nicht für:

Indirekte, zufällige, besondere, Folge- oder Strafschäden
Entgangenen Gewinn, Datenverlust oder Verlust von Geschäftswert
Personenschäden oder Sachschäden
Schäden, die den von Ihnen in den letzten 12 Monaten gezahlten Betrag übersteigen

Diese Beschränkung gilt unabhängig vom Rechtsgrund des Anspruchs (Vertrag, Delikt oder sonstige).

8. Eigenverantwortung

Sie tragen die Verantwortung für Ihre Nutzung der App und die Folgen eines Missbrauchs. Entstehen uns oder Dritten durch Ihr Handeln Schäden oder Ansprüche — etwa durch die Verletzung dieser Bedingungen oder den Missbrauch der Kontakt-Funktion — tragen Sie die Verantwortung dafür.

9. Kontokündigung

Sie können Ihr Konto jederzeit über die Einstellungen löschen.

Wir können Ihr Konto sperren oder kündigen, wenn Sie:

Diese Nutzungsbedingungen verletzen
Die App für illegale Zwecke nutzen
Die Kontakt-Funktion missbrauchen
Belästigung oder Missbrauch betreiben

Bei Kündigung werden alle Ihre Daten gemäß unserer Datenschutzerklärung gelöscht.

10. Änderungen

Wir können diese Bedingungen jederzeit ändern. Über wesentliche Änderungen informieren wir Sie über die App oder per E-Mail.

Ihre weitere Nutzung der App nach Änderungen gilt als Annahme der neuen Bedingungen.

Wenn Sie den geänderten Bedingungen nicht zustimmen, sollten Sie die Nutzung der App einstellen und Ihr Konto löschen.

11. Anwendbares Recht und Gerichtsstand

Diese Bedingungen unterliegen dem Recht der Bundesrepublik Deutschland.

Für alle Streitigkeiten aus oder im Zusammenhang mit diesen Bedingungen oder der Nutzung der App ist ausschließlich das Amtsgericht Steinfurt zuständig.

Verbraucher können sich zusätzlich auf die zwingenden Verbraucherschutzvorschriften ihres Wohnsitzlandes berufen. EU-Verbraucher können zudem die Online-Streitbeilegungsplattform nutzen: https://ec.europa.eu/consumers/odr

12. Salvatorische Klausel

Sollte eine Bestimmung dieser Bedingungen unwirksam sein, bleiben die übrigen Bestimmungen in vollem Umfang wirksam.
